Assuming the damages are punitive damages, medical malpractice damages do not have caps. While certain states have passed laws capping damages, the Supreme Court of Washington ruled such caps unconstitutional.
The reason for banning caps is that they implicitely violate a person's right to a jury. For this reason, individuals may receive medical malpractice damages of any amount.
