Military Claims

Everyone who is treated at a military medical facility has a right to bring a claim for malpractice or negligent medical treatment EXCEPT active duty service members.

Many people use these facilities who are not on active duty: spouses or children of the service members, or retired service members, are a few examples. Military dependents and retired service members are allowed to bring claims and lawsuits against the government if they receive improper treatment.
